What is Legislative Tracking and Analysis?

How can we determine if an enacted legislative measure is effective or not? How can we say if the local legislators address the needs and aspirations of the its local people through the implemented ordinances? This article provides some information on the scheme on how to assess and monitor the enacted ordinances and resolutions.

Local legislation is the rule-making function of an LGU or local government unit to provide the socio-cultural, economic, political development, and environmental needs of its territorial jurisdiction. It also refers to the power of the sanggunian to enact rules in the form of a resolution or ordinance for the welfare of the local people.

The local legislation is said to be effective if it can address the needs and aspirations of the people, and if the people participate in the implementation of the ordinance and resolution. However, the success of the legislation is also determined by an effective monitoring tool to check on the implementation of a resolution or ordinance.

What is Legislative Tracking and Analysis?

In the Philippine context, legislative tracking and analysis is a monitoring scheme or process to help the sanggunian to determine the effectiveness or non-effectiveness of an enacted resolution or ordinance.

This monitoring process is used by local government units (LGUs) to evaluate the viability of an enacted resolution / ordinance in satisfying the needs of the target beneficiaries. In addition, it encourages assessment which may need further legislative action. And lastly, it can provide feedbacks on the effectiveness of an enacted measure.

Steps in Conducting the Legislative Tracking and Analysis

  1. Verify from the local government department if there is an enacted ordinance or resolution
  2. Conduct field surveys and random interviews to determine the awareness of the target population on the enacted measure
  3. Conduct dialogues with the target beneficiaries and other individuals involved to assess the effectiveness of the implementation
  4. Prepare a written report. If there are negative feedbacks, recommend and suggest other options or alternatives to the sanggunian.

Legislative Backstopping Committee (LBC) serves as the research arm of the sanggunian. The main function is to assist the sanggunian in the tracking and analysis of the enacted measures. Ideally, the committee has to be composed of experts in political science, sociology, environmental urban planning, economics, compute technology, and law.

It has been said that the pursuit of excellence in the local governance should start with a clear vision among the leaders for good governance and transparency. It is imperative for local executives to have the dedication and commitment to carry out the responsibilities to be of good service to the people. In order for the local legislators to better perform their legislative tasks in setting the policy environment for a more meaningful governance there is a need to institutionalize the legislative tracking and analysis to gather the needed feedbacks in the implementations of legislative measures.
